Zero Tolerance Guarantee terms & conditions

This agreement applies to any settlement service ordered online at http://www.federaltitle.com that is placed by a licensed mortgage lender, a licensed real estate agent, or a borrower and/or homebuyer and performed by and through Federal Title & Escrow Company, a District of Columbia corporation (hereafter, “FTE”).

FTE guarantees that, if used correctly, the closing costs quote (specifically, HUD-1 series line items 1100 “Title Charges” and 1200 “Government Recording and Transfer Charges”) produced and delivered through its proprietary online order system (“FTE Order”) will comply with the Good Faith Estimate (“GFE”) tolerance requirements established and set forth by the U.S. Department of Housing and Urban Development (“HUD”) and published in HUD's final Real Estate Settlement Procedures Act (“RESPA”) rule effective January 1, 2010.

For settlement services performed by FTE and for which and to the extent a mortgage lender correctly uses and relies on the FTE Order for the purpose of preparing the respective GFE, FTE agrees to reduce its appropriate fees and/or pay any overages within a 30 (thirty) day period after the date of settlement. This agreement will be limited to the dollar amount differential between the provided FTE Order and the final HUD-1 executed on the date of settlement. This agreement does not cover or extend to any other RESPA violations, including but not limited to, Section 4 violations as well as any other violations of local, state or federal laws and/or regulations.

This guarantee agreement is limited specifically to Federal Title and is not underwritten or guaranteed by any insurer.
