Encroachments onto a neighbor’s property – A question of marketability of title

    Having read this article I got to know more but I am wondering if mine is a title issue.
    After living in the house for 8 years and I found out that a strip of my driveway is on my neighbor’s property. Without that strip of land I won’t be able to access to my build in garage and I have no way to relocate the driveway due to the structure of the house. Neither the title insurance company nor my attorney release the encroachment to me at the closing. Do you think the title company should be responsible for helping me to fix it?

    Hi there,
    Not sure if the title company or title insurance company will be responsible, as it will depend on what was disclosed. You should file a title claim based on the title insurance policy and they will at least have to address it and suggest what can be done.
